§ 26-13. Enforcing filing of such inventories.

If any fiduciary fails to make the return required by § 26-12, thecommissioner shall issue, through the sheriff or other proper officer, asummons to such fiduciary, requiring him to make such return; and if suchreturn is not made within 30 days after the date of service of the summons,the commissioner shall report the fact to his court. The court shallimmediately thereupon order a summons to the fiduciary, requiring him toappear; and upon his appearing unless excused for sufficient reason, he shallbe fined by the court in a sum not to exceed $500. If the fiduciary stillfails to make the return within such time as the court may prescribe, heshall be deemed guilty of contempt of court, and be dealt with accordingly.

Whenever the commissioner reports to the court that a fiduciary, who is anattorney-at-law licensed to practice in the Commonwealth, has failed to makethe required return within 30 days after the date of service of a summons,the commissioner shall also mail a copy of his report to the Virginia StateBar.
