§ 3.2-3105. Appointment of director; Commission employees; counsel to theCommission.

A. The Governor shall appoint an executive director subject to confirmationby the General Assembly. The compensation shall be determined by theCommission, subject to approval by the Governor. The executive director shallserve as the secretary to the Commission and shall administer the affairs andbusiness of the Commission in accordance with the provisions of this chapterand subject to the policies, control, and direction of the Commission. TheCommission may employ technical experts and other officers, agents, andemployees, permanent and temporary, as it requires, and shall determine theirqualifications, duties, and compensation. The Commission may delegate to oneor more of its agents or employees the administrative duties it deems proper.The actual expenses incurred in the performance of such duties shall be paidfrom the Fund.

B. Employees of the Commission shall be treated as state employees forpurposes of participation in the Virginia Retirement System, healthinsurance, and all other employee benefits offered by the Commonwealth to itsclassified employees. Employees of the Commission shall not be subject to theprovisions of Chapter 29 (§ 2.2-2900 et seq.) of Title 2.2.

C. The Office of the Attorney General shall provide counsel to the Commission.
