§ 3.2-4013. Seizure; disposition of seeds.

Any lot of agricultural, vegetable, flower, tree and shrub, lawn and turfseeds, mixtures of such seeds, or screenings sold, offered for sale, or heldwith intent to sell contrary to the provisions of this article shall besubject to seizure on complaint of the Commissioner to the appropriate court.If the court finds the seeds, mixtures of seeds, or screenings in violationof this article and orders condemnation, such seeds, mixtures of seeds, orscreenings shall be denatured, processed, destroyed, relabeled, or otherwisedisposed of; provided, that the court first allows the claimant anopportunity to apply for the release of the seeds, mixtures of such seeds, orscreenings, or permission to condition or relabel to bring the material intocompliance.
