§ 3.2-5623. Information to be shown on packages.

Except as otherwise provided in this chapter, any commodity in package form,introduced or delivered for introduction into, or received in, intrastatecommerce, kept for the purpose of sale, or offered or exposed for sale, shallbear on the outside of the package a definite, plain, and conspicuousdeclaration of: (i) the identity of the commodity in the package unless thesame can easily be identified by an actual or prospective buyer through thewrapper or container; (ii) the net quantity of the contents in terms ofweight, measure, or count; and (iii) in the case of any package kept,offered, or exposed for sale, or sold any place other than on the premiseswhere packed, the name and place of business of the manufacturer, packer, ordistributor. In connection with the declaration required under clause (ii) ofthis section the qualifying term "when packed," or words of similar importshall not be used, nor shall any term qualifying a unit of weight, measure,or count including "jumbo," "giant," "full" that tends to exaggeratethe amount of commodity in a package be used.

The Uniform Regulation for Packaging and Labeling as adopted by the NationalConference on Weights and Measures and published in National Institute ofStandards and Technology Handbook 130, "Uniform Laws and Regulations," andsupplements thereto or revisions thereof, shall apply to the method of saleof commodities in the Commonwealth, except insofar as modified or rejected byregulation.
