§ 3.2-5631. Representations as to price; signs advertising price of petroleumproducts.

Whenever any commodity or service is sold, or is offered, exposed, oradvertised for sale, by weight, measure or count, the price shall not bemisrepresented, nor shall the price be represented in any manner tending tomislead or deceive an actual or prospective purchaser. Whenever anadvertised, posted, or labeled price per unit of weight, measure, or countincludes a fraction of a cent, all elements of the fraction shall beprominently displayed and the numerals expressing the fraction shall beimmediately adjacent to, of the same general design and style as, and atleast one half the height and width of, the numerals representing the wholecents. Whenever the price of petroleum products is advertised or posted atretail, the amount of any taxes may not be shown separately in suchadvertising or posting unless the words "plus tax" and the numeralsexpressing the taxes are prominently displayed in letters and numerals of thesame general design and style as, and at least one half the height and widthof, the numerals representing the price as specified in this section. Thetotal price of the petroleum products so advertised or posted shall notdiffer from the price as shown on the pump or in any computed price chargedthe customer.
