§ 32.1-325.3. Disclosure or use of information for purpose not connected withmedical assistance program; Department not subject to certain disclosure.

The Board of Medical Assistance Services shall promulgate regulationsconsistent with federal law to provide safeguards against the use ordisclosure of information concerning applicants for and recipients of medicalassistance services for any purpose which is not directly connected with theadministration of the state plan for medical assistance services.

Information in the possession or control of the Department concerningapplicants for and recipients of medical assistance services shall not besubject to disclosure through discovery in litigation to which the Departmentis not a necessary party, unless the appropriate circuit court, for goodcause shown, shall order such disclosure.
