§ 33.1-117. Taking road materials from streams, rivers and watercourses.

Whenever the Commonwealth Transportation Commissioner determines that it isnecessary or desirable to remove materials from the streams, rivers orwatercourses for use on public roads, he shall submit to the Marine ResourcesCommission his plan for the removal and all conditions relating thereto forits review and concurrence. After receiving the concurrence of the MarineResources Commission, the Commonwealth Transportation Commissioner may takefor use on the public roads in this Commonwealth sand, gravel, rock and anyother materials deemed by him suitable for road purposes from the streams,rivers and watercourses, title to the bed of which is in the Commonwealth,and in addition to the power of eminent domain already vested in him mayacquire by condemnation all property, rights and easements necessary toenable him to obtain and make use of such materials. All such proceedingsshall be governed by the provisions of law governing the exercise by theCommonwealth Transportation Commissioner of the power of eminent domain forstate highway purposes.
