§ 33.1-49.1. Contracts for maintenance of components of Interstate HighwaySystem.

All maintenance on components of the Interstate Highway System in Virginia,excluding frontage roads, shall be carried out under contracts awarded by theCommonwealth Transportation Commissioner and approved by the CommonwealthTransportation Board pursuant to § 33.1-12, except for instances where goodand sufficient reasons for not doing so shall have been shown in advance inwriting by the Commonwealth Transportation Commissioner to the CommonwealthTransportation Board and to the chairmen of the House Committee onTransportation, the House Committee on Appropriations, the House Committee onFinance, the Senate Committee on Transportation and the Senate Committee onFinance. Nothing in this section shall be construed to prevent the VirginiaDepartment of Transportation from performing emergency work at any time onthe Interstate System with its own employees or agents or to assume themaintenance responsibilities of a contractor who has been determined to be indefault or as a result of a contract termination.
