§ 33.1-432. Commission to exercise powers of the district.

The powers of a district created pursuant to this chapter shall be exercisedby a commission. The commission shall consist of four members of thegoverning body, appointed by the governing body, plus one member of the towncouncil of any participating town, appointed by the town council of theparticipating town. In addition to the foregoing, the Chairman of theCommonwealth Transportation Board or his designee shall be a member of thecommission of any district created pursuant to this chapter.

The members of the commission shall elect one of their number chairman of thecommission. The chairman may be the chairman or presiding officer of thegoverning body. In addition, the members of the commission, with the adviceof the district advisory board, shall elect a secretary and a treasurer, whomay be members or employees of the governing body, the town council of aparticipating town, or other governmental body. The offices of secretary andtreasurer may be combined. A majority of the commission members shallconstitute a quorum, and a majority vote shall be necessary for any actiontaken by the commission. No vacancy in the membership of the commission shallimpair the right of a majority of the members to form a quorum or to exerciseall of its rights, powers, and duties.
