§ 33.1-225.3. Funds for roads not in secondary system.

Notwithstanding the provisions of § 33.1-225 or § 33.1-230, the governingbody of any county under the urban county executive form of government mayexpend funds on minor improvements and maintenance of roads not within thesecondary highway system, provided such roads are open for public use. A roadshall be determined to be open for public use by applying the same standardsset forth in § 33.1-184 or by final order of a court of competentjurisdiction on or before January 1, 1978, except that in order to beeligible for funds under this section such roads need not be thirty feet inwidth but shall not be less than fifteen feet wide. The maximum amount ofmileage to be maintained under this section shall not exceed thirty miles.
