§ 36-85.12. Violation; civil and criminal penalties.

It shall be unlawful for any person, firm or corporation, to violate anyprovisions of this law, the rules and regulations enacted under authority ofthis law, or the Federal Law and Regulations. Any person, firm or corporationviolating any provision of said laws, rules and regulations, or any finalorder issued thereunder, shall be liable for civil penalty not to exceed$1,000 for each violation. Each violation shall constitute a separateviolation with respect to each manufactured home or with respect to eachfailure or refusal to allow or to perform an act required by the legislationor regulations. The maximum civil penalty may not exceed one million dollarsfor any related series of violations occurring within one year from the dateof the first violation.

An individual or a director, officer, or agent of a corporation who knowinglyand willfully violates Section 610 of the National Manufactured HousingConstruction and Safety Standards Act in a manner which threatens the healthor safety of any purchaser shall be deemed guilty of a Class 1 misdemeanorand upon conviction fined not more than $1,000 or imprisoned not more thanone year, or both.
