§ 40.1-51.39. Penalties; chapter not to affect right to relief or to maintainaction.

A. Any owner violating any provision of this chapter, Board regulation, ororder of the Commissioner shall upon conviction be guilty of a misdemeanorand shall be subject to a fine of not more than $1,000 for each violationwithin the discretion of the court. Each day of continued violation afterconviction shall constitute a separate offense.

B. Nothing in this chapter shall be construed to abridge, limit, impair,create, enlarge or otherwise affect substantively or procedurally the rightof any person to damages or other relief on account of injury to persons orproperty.
