§ 40.1-101. Qualifications as to theaters.

Notwithstanding the provisions of §§ 40.1-100 and 40.1-100.1, a child undersixteen years of age, whether a resident or nonresident of the Commonwealth,may be employed, permitted or suffered to participate in the presentation ofa drama, play, performance, concert or entertainment, provided the managementof the theater or other public place where such performance is to be held inthe Commonwealth shall secure a permit from the Commissioner; provided, thatno such permit shall be required for any nonprofit dance or music recital,nor for any television or radio broadcast in which the children participatingare selected by the television or radio broadcasting station for sustainingnoncommercial programs.
