§ 44-146.39. State Hazardous Materials Emergency Response Advisory Councilcreated; membership; responsibilities.

A. There is hereby created the State Hazardous Materials Emergency ResponseAdvisory Council, hereinafter referred to in this chapter as the "Council."The Council shall consist of such state agency heads or their designatedrepresentatives as the Governor shall appoint and nine other membersappointed by the Governor. Those nine members shall be representative oflocal government, industry, the general public, and environmental andemergency response interests. The Governor shall designate a chairman fromamong the Council members and the Council shall meet at the call of thechairman. Upon initial appointment three of the nine nonstate agencyrepresentatives shall be appointed for three-year terms, three for two-yearterms, and three for one-year terms. Thereafter, each shall be appointed fora term of three years.

B. The Department of Emergency Management shall provide staff support for theCouncil. State agencies shall cooperate in providing assistance and adviceupon request of the Council to the Coordinator. Expenses incurred as a resultof Council functions shall be paid by the Department of Emergency Managementfrom an appropriation for that purpose.

C. The Council shall provide programmatic advice to the Coordinator in thedevelopment and implementation of the Virginia Hazardous Materials EmergencyResponse Program. The Council shall study and make recommendations on allaspects of the Virginia Hazardous Materials Emergency Response Programincluding, but not limited to, planning, organization, equipment, training,funding, accident prevention and enforcement of regulations.

D. The Council shall provide advice to the Virginia Emergency ResponseCouncil.
