§ 45.1-161.36. Reexamination.

The holder of a certificate revoked pursuant to § 45.1-161.35 shall beentitled to examination by the Board of Coal Mining Examiners after threemonths have elapsed from the date of revocation of the certificate if he canprove to the satisfaction of the Board that the cause for revocation of hiscertificate has ceased to exist. However, no person convicted of violatingsubsection A of § 45.1-161.177 or §§ 45.1-161.178, 45.1-161.232, or §45.1-161.233 shall be eligible for examination for a period of not less thanone year nor more than three years following such conviction, such period tobe set by the Board in its discretion at the time of revocation of thecertificate.
