§ 45.1-161.292:8. Notifying miners of violations; compliance with Act.
A. The operator and his agent shall cooperate with the mine foreman,competent person and other officials in the discharge of their duties asrequired by this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and 14.6(§ 45.1-161.304 et seq.), and shall direct that all miners comply with allprovisions of this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and14.6 (§ 45.1-161.304 et seq.), especially when his attention is called to anyviolation of this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and 14.6(§ 45.1-161.304 et seq.) by the Director or a mine inspector.
B. The operator of any mine or his agent shall operate in full conformitywith this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and 14.6 (§45.1-161.304 et seq.) and any other mining law of the Commonwealth at alltimes. This requirement shall not relieve any other person subject to theprovisions of this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and14.6 (§ 45.1-161.304 et seq.) from his duty to comply with the requirementsof this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and 14.6 (§45.1-161.304 et seq.).
C. Nothing in this chapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and14.6 (§ 45.1-161.304 et seq.) shall be construed to relieve an operator orhis agent from the duty imposed at common law to secure the reasonable safetyof his employees.
D. No operator, agent, competent person, or certified person shall knowinglypermit any person to work in any part of a mine in violation of writteninstructions issued by a mine inspector pursuant to this chapter and Chapters14.5 (§ 45.1-161.293 et seq.) and 14.6 (§ 45.1-161.304 et seq.).
