§ 45.1-161.309. Health regulations.

A. The Director shall have the authority to promulgate regulations requiringthat sources of dust at surface mineral mines be wetted down unlesscontrolled by dry collection measures, or other means approved by theDirector.

B. The Director shall have the authority to promulgate regulations providingthat miners at surface mineral mines which are subject to inspection by theDepartment pursuant to § 45.1-161.292:54 shall not be exposed to noise levelsthat exceed the federal limit adopted by the Mine Safety and HealthAdministration for non-coal miners. The regulations shall provide that ifsuch exposure exceeds the federal limit, the Director may require theoperator to employ feasible engineering and administrative control measures.
