§ 51.1-1126. Rehabilitation incentive.

Supplemental disability benefits payable to a participating employee whofails to cooperate with a rehabilitation program prescribed for the employeeshall be decreased by fifty percent of the amounts otherwise payable to suchemployee. In determining the amount of any reduction in benefits under thissection, the participating employee shall be presumed to continue to receivebenefits payable under the Act. Failure to comply with a vocationalrehabilitation assessment process at any time the employee is receivingsupplemental disability benefits may constitute a failure to cooperate forpurposes of this section.
