§ 51.5-39.12. Notification of critical incidents and deaths in statefacilities.

Notwithstanding any other provision of law, the directors of state facilitiesas defined in § 37.2-100 shall notify the Director of the Office in writingwithin forty-eight hours of critical incidents or deaths of patients orresidents in state facilities. For purposes of this section, a criticalincident shall be defined as serious bodily injury or loss of consciousnessrequiring medical treatment. The Commissioner of the Department of BehavioralHealth and Developmental Services shall provide to the Director of the Officea written report setting forth the known facts of critical incidents ordeaths of patients or residents of state facilities within fifteen workingdays of the critical incident or death.
