§ 55-248.47. Sale or lease of manufactured home by owner.

The landlord shall not unreasonably refuse or restrict the sale or rental ofa manufactured home located in his manufactured home park by a tenant. Thelandlord shall not prohibit the manufactured home owner from placing a "forsale" sign on or in his home except that the size, placement, and characterof all signs are subject to the rules and regulations of the park. Prior toselling or leasing the manufactured home the tenant shall give notice to thelandlord, including, but not limited to, the name of the prospective vendeeor lessee if the prospective vendee or lessee intends to occupy themanufactured home in that manufactured home park. The landlord shall have theburden of proving that his refusal or restriction regarding the sale orrental of a manufactured home was reasonable. The refusal or restriction ofthe sale or rental of a manufactured home based exclusively or predominantlyon the age of the home shall be considered unreasonable. Any refusal orrestriction because of race, color, religion, national origin, familialstatus, elderliness, handicap, or sex shall be conclusively presumed to beunreasonable.
