§ 59.1-293.9. (For contingent expiration, see Editor's note) Application ofchapter to certain cigarettes; conflicting local ordinances preempted.

A. Nothing in this chapter shall be construed to prohibit any person frommanufacturing or selling cigarettes that do not meet the requirements of thischapter if the cigarettes are or will be stamped for sale in another state orsold in North Carolina or South Carolina, or are packaged for sale outsidethe United States, and that person has taken reasonable steps to ensure thatsuch cigarettes will not be sold or offered for sale to persons located inthe Commonwealth.

B. Notwithstanding any other provision of law, a locality may neither enactnor enforce any ordinance or other local law or regulation that conflictswith, or is inconsistent with, any provision of this chapter.
