§ 6.2-1826. (Effective October 1, 2010) Validity of noncompliant loanagreement; private right of action.

A. If any provision of a written loan agreement violates this chapter, suchprovision shall be unenforceable against the borrower.

B. Any person who suffers loss by reason of a violation of any provision ofthis chapter may bring a civil action to enforce such provision. Any personwho is successful in such action shall recover reasonable attorney fees,expert witness fees, and court costs incurred by bringing such action.
