§ 62.1-82. Control and regulation by State Corporation Commission; existingrights of riparian owners.

The control and regulation on the part of the Commonwealth of the developmentof the waters of the Commonwealth shall be paramount, and shall be exercisedthrough the agency of the State Corporation Commission, sometimes in thischapter referred to as the Commission; provided, however, nothing containedin this chapter shall deprive any riparian owner of any right which he mayhave, under existing law, except by due and further process of law upon theexercise of eminent domain and upon the payment of just compensation for anysuch right.
