§ 63.2-318. Payment of legal fees and expenses for certain local departmentemployees.

If any employee of a local department is arrested, indicted or otherwiseprosecuted on any criminal charge arising out of an act committed in thedischarge of his official duties, and the charge is subsequently terminatedby entry of an order of dismissal, or nolle prosequi or upon trial he isfound not guilty, the local board by which he is employed may reimburse suchemployee for all or part of the legal fees and expenses incurred by theemployee in defense of such charge. The Department may reimburse the localboard all or any part of such expenditures at the same rate in effect for allother administrative costs at the time of the expenditure to the extent thatfunds are available.
