6B.40  FAILURE TO RECORD -- LIABILITY.
 Any sheriff, or clerk of the district court, as the case may be,
 who fails to present said papers, statements, and certificate for
 record, and any recorder who fails to record the same as above
 provided shall be liable for all damages caused by such failure.
