        8.40  PENALTY -- REMOVAL -- IMPEACHMENT.
         A refusal to perform any of the requirements of this chapter, or a
      refusal to perform a rule or requirement or request of the governor
      or the director of the department of management made pursuant to this
      chapter, by a board member, commissioner, director, manager, building
      committee, other officer or person connected with any institution, or
      other state department or establishment, subjects the offender to a
      penalty of two hundred fifty dollars, to be recovered in an action
      instituted in the district court of Polk county by the attorney
      general for the use of the state.  If the offender is not an officer
      elected by vote of the people, the offense is sufficient cause for
      removal from office or dismissal from employment by the governor upon
      thirty days' notice in writing to the offender; and if the offender
      is an officer elected by vote of the people, the offense is
      sufficient cause to subject the offender to impeachment.
