17:12B-123.Ā  Merits of application;Ā  determinations by commissioner
At such hearing, or such independent examination or investigation as the commissioner may make, the commissioner shall examine into the merits of the application and if he determines that the application is made in good faith andĀ  to grant the application would not be detrimental to the best interests of theĀ  State association and its members;Ā  then the commissioner shall:

(a) If the application is for information, grant the application in whole orĀ  in part, and impose such terms and conditions as he shall deem necessary orĀ  proper to protect the best interest of the State association and its members,Ā  or

(b) If the application is to enable the applicant to communicate with otherĀ  members of the State association, order the State association to prepare andĀ  mail the communication or communications, in whole or in part, on the conditionĀ  that the applicant shall first pay to the State association all of the costsĀ  and expenses of such preparation and mailing.

Nothing herein shall be construed to give the commissioner the power to order a State association to disclose a list of its members to any applicant.
