24:5-9.Ā Confectionery adulterations
For the purposes of this subtitle, confectionery shall be deemed adulteratedĀ if it bears or contains any alcohol, or nonnutritive article or substanceĀ except harmless coloring, or if a coal-tar color one from a batch which hasĀ been certified under the Federal Act, harmless flavoring, harmless resinousĀ glaze not in excess of 4/10 of 1%, natural gum and pectin; provided, thatĀ this paragraph shall not apply to any confectionery by reason of its containingĀ less than 5% by volume of alcohol or to any chewing gum by reason of itsĀ containing harmless nonnutritive masticatory substances.
