26:2H-40.Ā Defenses
It shall be a sufficient defense to the proceeding if the owner or licenseeĀ establishes that the condition or conditions alleged in the complaint do not inĀ fact exist or that such condition or conditions have been removed or remediedĀ or that such condition or conditions, although periodically remedied, have notĀ habitually existed as pattern and practice.
