32:2-23.13.Ā Acquisition of real property
If the Port Authority shall find it necessary or convenient to acquire any real property for Narrows Bridge purposes (including temporary construction, rehabilitation or improvement), whether for immediate or future use, the Port Authority may find and determine that such property, whether a fee simple absolute or a lesser interest, is required for a public use, and upon such determination the said property shall be and shall be deemed to be required forĀ such public use until otherwise determined by the Port Authority, and suchĀ determination shall not be affected by the fact that such property has theretofore been taken for and is then devoted to a public use;Ā but the publicĀ use in the hands of or under the control of the Port Authority shall be deemedĀ superior to the public use in the hands of any other person, association orĀ corporation. If the Port Authority shall find it necessary or convenientĀ hereunder to acquire any real property which is then devoted to a public use,Ā the Port Authority shall have power to exchange or substitute any other real property for such real property, upon terms agreed to by the Port Authority andĀ the owner of such property then devoted to a public use, and to find andĀ determine that such other real property is also required for a public use; upon such determination the said other property shall be and shall be deemedĀ to be required for such public use.
The Port Authority may acquire and is hereby authorized to acquire any realĀ property in the State of New York required for a public use under the precedingĀ paragraph, whether a fee simple absolute or a lesser estate, by condemnation orĀ the exercise of the right of eminent domain under and pursuant to theĀ condemnation law of the State of New York, or at the option of the PortĀ Authority pursuant to any other and alternate procedure provided by law by suchĀ State.Ā Nothing herein contained shall be construed to prevent the PortĀ Authority from bringing any proceedings in either State to remove a cloud onĀ title or such other proceedings as it may, in its discretion, deem proper andĀ necessary, or from acquiring any such property in either State by negotiationĀ or purchase.
Where a person entitled to an award in the proceedings to condemn any real property for Narrows Bridge purposes remains in possession of such property after the time of the vesting of title in the Port Authority, the reasonable value of his use and occupancy of such property subsequent to such time, as fixed by agreement or by the court in such proceedings or by any court of competent jurisdiction, shall be a lien against such award, subject only to liens of record at the time of the vesting of title in the Port Authority.
