32:27-25.Ā Attributes of sovereign immunity
The commission, as an instrumentality of the State of New Jersey and the Commonwealth of Pennsylvania exercising a governmental function may not be suedĀ in any court of law or equity and shall be vested with such attribute of sovereign immunity in its transactions within the boundaries of one or the other of the 2 States as shall apply to the respective highway and/or transportation departments thereof and no more.Ā If the commission is liable inĀ one State and would not have been liable in the other State, the State whereinĀ such liability exists shall be solely obligated to discharge such liability, asĀ well as any costs, fees, or expenses imposed upon or incurred by theĀ commission, notwithstanding any other provisions of this agreement.
