33:2-3.Ā Seizure of unregistered stills;Ā search warrant;Ā arrest of offenders
Any officer knowing or having reasonable cause to believe that any still orĀ distilling apparatus or any parts thereof constitute such unlawful property, itĀ shall be his duty to investigate, under proper search warrant when necessary,Ā which it shall be his further duty to apply for, and to seize such still orĀ distilling apparatus or parts thereof, together with all articles, implementsĀ or paraphernalia used or adaptable for use in connection therewith and allĀ personal property of whatsoever kind, found in a building or in any yard orĀ inclosure connected with a building or on the premises in which such still orĀ distilling apparatus or parts thereof are found, and to arrest all persons whomĀ he shall know, or have reasonable ground to believe, are committing, or haveĀ committed, a misdemeanor under this chapter and to make complaint against suchĀ persons as in other cases of misdemeanors.Ā All property when seized shall beĀ under the jurisdiction of the commissioner.
