38A:13-8.Ā Death in line of duty;Ā benefits
In the event a member of the organized militia on active duty ordered by competent authority, is killed or dies within 2 years from injuries sustained in such line of duty, he shall, in addition to the benefits provided by sectionĀ 38A:13-1, be entitled to have a lump sum death benefit of $7,500.00 paid by theĀ State on his account.Ā Such death benefit shall be paid to the deceasedĀ militiaman's wife, if any, otherwise to his children, if any, in equal shares,Ā and otherwise to those who would be entitled to share in his estate if he hadĀ died intestate.
