4:9-15.30.Ā Misbranding
No person shall distribute a misbranded product.Ā A commercial fertilizer orĀ soil conditioner shall be deemed to be misbranded:
(a) If its labeling is false or misleading in any particular.
(b) If it is distributed under the name of another product.
(c) If it is not labeled in accordance with any applicable provisions of sections 10, 11, 12, 13, 14 and 15 of this act and of regulations prescribed under this act.
(d) If it purports to be or is represented as a commercial fertilizer, or isĀ represented as containing a plant nutrient or commercial fertilizer, unlessĀ such plant nutrient or commercial fertilizer conforms to the definitions orĀ terms prescribed by regulation.Ā In the adoption of such regulations due regardĀ shall be given to commonly accepted definitions and official fertilizer termsĀ such as those issued by the Association of American Plant Food ControlĀ Officials.
