40:14-17.Ā Establishment by ordinance or resolution;Ā terms
The establishment of such joint commission shall be by ordinance, in the case of a municipality, and by resolution, in the case of a county.Ā Each such ordinance or resolution shall incorporate therein the basic terms under which such participants shall agree to organize.
Such terms may include provisions governing:
a.Ā Limitations or requirements as to eligibility for membership, such as provisions requiring or limiting representation to elected officials or personsĀ who do not hold elective office, or combination thereof;
b.Ā Any agreement as to the number of members present, or participants represented, as may be required to constitute a quorum for the transaction of business;
c.Ā The method of apportioning the expenses of the commission, which may beĀ on the basis of population, or land or drainage area, or on the basis of apportionment valuations, as defined in R.S. 54:4-49, of the constituent municipalities, or on any combination thereof, or on any other basis as may be agreeable to the participating members;
d.Ā Any provisions regarding the right of any participating municipality orĀ county to withdraw from the commission, and the period of notice required forĀ such withdrawal to become effective.
e.Ā Such other terms as the proposed participants believe should be includedĀ in the initial agreement.
