If the clerk upon receipt of a proper order shall refuse or neglect to callĀ or convene any special meeting of the board, he shall forfeit twenty-fiveĀ dollars, to be recovered, with costs, in an action in any court of competentĀ jurisdiction, in the name and for the use of the county.
