43:13-22.24.Ā Medical examination yearly of persons retired for disability
Once each year the commission may require any member retired for disability,Ā who is under the age of 60 years to undergo medical examination by a physicianĀ or physicians designated by the commission.Ā The examination may be made at theĀ residence of the pensioner or other place mutually agreed upon.Ā If theĀ physician or physicians thereupon report and certify to the commission that theĀ pensioner is not permanently and totally incapacitated, either physically orĀ mentally, for the performance of the duties which were performed by theĀ pensioner before retirement on disability, then the commission shall order saidĀ pensioner to be taken from the pension rolls and restored to the position heldĀ by said pensioner before his or her retirement.
