58:16A-55.4.Ā County stormwater control and drainage plans;Ā utilization onĀ determinations of approval
Any county governing body may prepare a stormwater control and drainage planĀ for the county.Ā Such plans shall be prepared after consultation and discussionĀ with the Department of Environmental Protection and with adjacent counties andĀ shall consider and evaluate the impact of any developments within the county orĀ upstream from the county on the streams within the county and downstream fromĀ the county.Ā Such plans may be financed in part from theĀ "Emergency FloodĀ Control Bond Act"Ā (P.L.1978, c. 78).Ā County stormwater control and drainageĀ plans prepared as herein provided shall be utilized by the department inĀ deciding to approve or disapprove any application submitted pursuant to thisĀ act.
