22-5-204. Clerk. [Effective in Certain Counties. See the Compiler’s Notes.]

(a)  (1)  The clerk of the circuit court of the county shall be the clerk of the board of jury commissioners of that county, and shall perform all the duties required of the clerk by this chapter and all clerical and other duties required by law.

     (2)  Before entering upon the duties as clerk of the board, the clerk of the circuit court shall take and subscribe, before an officer authorized to administer oaths, the following oath:

“I,  _____________________________________________________________________ , do solemnly swear that I will faithfully and impartially discharge the duties imposed upon me as a member of the board of jury commissioners of  _____________________________________  County to the best of my knowledge and ability; that I will never place the name of any person on the jury list or in the jury box whom I believe to be corrupt or unfit, or who is known not to be in sympathy with the enforcement of the law, who is a law violator, or who has to my knowledge solicited or had others to solicit that the person's own name be placed on the jury list; and that I will keep secret and inviolate the deliberations, proceedings and counsel of this board in the discharge of its duties; unless called upon to give evidence thereof in some legal tribunal of this state, so help me God.”

     (3)  If the clerk becomes ill, or is absent for any cause when the clerk's services as clerk of the board of jury commissioners are required, the clerk's deputy may take the same oath prescribed for the clerk and thereafter perform the duties devolving upon the clerk in the clerk's absence.

(b)  In any county having a population in excess of eight hundred thousand (800,000), according to the 1990 federal census or any subsequent federal census, or in any county having a metropolitan form of government, the board of jury commissioners may select and employ some person other than the circuit court clerk to be the clerk of the board of jury commissioners. Such selection shall be subject to the approval of the state trial judges in any such county, and the compensation of such clerk shall be set by the legislative body of any such county.
