39-17-406. Controlled substances in Schedule I.

(a)  Schedule I consists of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section.

(b)  Opiates.  Unless specifically excepted or unless listed in another schedule, any of the following opiates, including their isomers, esters, ethers, salts and salts of isomers, esters, and ethers, whenever the existence of the isomers, esters, ethers, or salts, is possible within the specific chemical designation:

     (1)  3-methylthiofentanyl (N-[(3-methyl-1-(2-thienyl)ethyl-4-piperidinyl]-N-phenylpro-panamide);

     (2)  Acetyl-alpha-methylfentanyl (N-[1-(1-methyl-2-phenethyl)-4-piperidinyl]-N-phenyl-acetamide);

     (3)  Acetylmethadol;

     (4)  Allylprodine;

(c)  Opium derivatives.  Unless specifically excepted or unless listed in another schedule, any of the following opium derivatives, its salts, isomers, and salts of isomers whenever the existence of the salts, isomers, and salts of isomers is possible within the specific chemical designation:

     (1)  Acetorphine;

     (2)  Acetyldihydrocodeine;

     (3)  Benzylmorphine;

     (4)  Codeine methylbromide;

     (5)  Codeine-N-Oxide;

     (6)  Cyprenorphine;

(d)  Hallucinogenic substances.  Unless specifically excepted or unless listed in another schedule, any material, compound mixture, or preparation, which contains any quantity of the following hallucinogenic substances, or which contains any of its salts, isomers, and salts of isomers whenever the existence of the salts, isomers, and salts of isomers is possible within the specified chemical designation. For purposes of this subsection (d) only, “isomer” includes the optical, positional and geometric isomers:

     (1)  2,5-dimethoxy-4-(n)-propylthiophenethylamine (2C-T-7);

     (2)  2,5-dimethoxyamphetamine (Some trade or other names: 2,5-dimethoxy-a-methylphenethylamine; 2,5-DMA);

     (3)  3,4,5-trimethoxy amphetamine;

     (4)  3,4-methylenedioxy amphetamine;

     (5)  3,4-methylenedioxy-N-ethylamphetamine (N-ethyl-alpha-methyl-3,4 (methylene-dioxy)phenethylamine, N-ethyl MDA, MDE, MDEA);

     (6)  4-bromo-2, 5-dimethoxy-amphetamine (Some trade or other names: 4-bromo-2, 5-dimethoxy-amethylphenethylamine; 4-bromo-2,5-DMA);

     (7)  4-methyl-2,5 dimethoxy-amphetamine;

     (8)  4-methoxyamphetamine (Some trade or other names: 4-methoxy-a-methylphenethylamine; paramethoxyamphetamine, PMA);

     (9)  5-methoxy-3,4-methylenedioxy-amphetamine;

     (10)  5-methoxy-N,N-disopropyltryptamine (5-MeO-DIPT);

     (11)  Bufotenine (Some trade and other names: 3-(B-Dimethylaminoethyl)-5-hydroxyindole; 3-(2-dimethylaminoethyl)-5-indolol; N, N-dimethylserotonin; 5-hydroxy-N, N-dimethyltryptamine; mappine);

     (12)  Diethyltryptamine (Some trade and other names: N, N-Diethyl-tryptamine; DET);

     (13)  Dimethyltryptamine (Some trade and other names: DMT);

     (14)  Ibogaine (Some trade and other names: 7-Ethyl-6, 6B, 7, 8, 9, 10, 12, 13 octahydro-2-methoxy-6, 9-methano-5H-pyrido [1, 2: 1, 2] azepino [5, 4-b] indole; Tabernathe iboga);

     (15)  Lysergic acid diethylamide;

     (16)  Mescaline;

     (17)  Parahexyl (Some trade and other names: 3-Hexyl-1-hydroxy-7, 8, 9, 10-tetrahydro-6, 6, 9-trimethyl-6H-dibenzo [b, d] pyran; Synhexyl);

     (18)  Peyote (Meaning all parts of the plant presently classified botanically as Lophophora williamsii Lemaire , whether growing or not, the seeds thereof, any extract from any part of such plant, and every compound, manufacture, salts, derivative, mixture, or preparation of such plant, its seeds or extracts. [Interprets 21 U.S.C. § 812(c) Schedule 1(c)(12)]);

     (19)  N-ethyl-3-piperidyl benzilate;

     (20)  N-hydroxy-3,4-methylenedioxyamphetamine (N-hydroxy-alpha-methyl-3,4 (methyl-enedioxy)phethylamine, N-hydroxy MDA);

     (21)  N-methyl-3-piperidyl benzilate;

     (22)  Psilocybin;

     (23)  Psilocyn;

     (24)  Ethylamine analog of phencyclidine (Some trade or other names: N-ethyl-1-phenylcyclohexylamine, (1-phenylcyclohexyl) ethylamine, N-(1-phenylcyclohexyl) ethylamine, cyclohexamine, PCE);

     (25)  Pyrrolidine analog of phencyclidine (Some trade or other names: 1-(1-phenylcyclohexyl)-pyrrolidine; PCPy; PHP); or

     (26)  Thiophene analog of phencyclidine (Some trade or other names: 1-[1-(2-thienyl)-cyclohexyl]-piperidine, 2-thienylanalog of phencyclidine; TPCP; TCP).

(e)  Depressants.  Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a depressant effect on the central nervous system, including its salts, isomers, and salts of isomers whenever the existence of the salts, isomers, and salts of isomers is possible within the specified chemical designation:

     (1)  Gamma-hydroxybutyric acid (some other names include GHB; gamma-hydroxybutyrate; 4-hydroxybutyrate; 4-hydroxybutanoic acid; sodium oxybate; sodium oxy-butyrate);

     (2)  Mecloqualone; or

     (3)  Methaqualone.

(f)  Stimulants.  Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers:

     (1)  Fenethylline;

     (2)  N-Benzylpiperazine (BZP, 1-benzylpiperazine);

     (3)  N-ethylamphetamine;

     (4)  Catha edulis (Khat or Chat) when cathinone is present;

     (5)  Methcathinone; or

     (6)  (+/-)cis-4-methylaminorex ((+/-)cis-4,5-dihydro-4-methyl-5-phenyl-2-oxazolamine).

(g)  Any material, compound, mixture or preparation that contains any quantity of the following substances:

     (1)  3-Methylfentanyl (N-[3-methyl-1-(2-phenylethyl)-4-piperidyl]-N-phenylpropanamide), its optical and geometric isomers, salts and salts of isomers;

     (2)  3, 4-methylenedioxymethamphetamine (MDMA), its optical positional and geometric isomers, salts and salts of isomers;

     (3)  1-methyl-4-phenyl-4-propionoxypiperidine (MPPP), its optical isomers, salts and salts of isomers;

     (4)  1-(2-phenylethyl)-4-phenyl-4-acetyloxypiperidine (PEPAP), its optical isomers, salts and salts of isomers;

     (5)  N-[1-(1-methyl-2-phenyl) ethyl-4-piperidyl]-N-phenylacetamide (acetyl-alpha-methylfentanyl), its optical isomers, salts and salts of isomers;

     (6)  N-[1-(1-methyl)-2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide (alpha-methylthiofentanyl), its optical isomers, salts and salts of isomers;

     (7)  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide (benzylfentanyl), its optical isomers, salts and salts of isomers;

     (8)  N-[1-(2-hydroxy-2-phenyl) ethyl-4-piperidyl]-N-phenylpropanamide (beta-hydroxyfentanyl), its optical isomers, salts and salts of isomers;

     (9)  N-[3-methyl-1-(2-hydroxy-2-phenyl) ethyl-4-piperidyl]-N-phenylpropanamide (beta-hydroxy-3-methylfentanyl), its optical geometric isomers, salts and salts of isomers;

     (10)  N-[3-methyl-1-(2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide;

     (11)  N-[1-(2-thienyl)methyl-4-piperidyl]-N-phenylpropanamide (thenylfentanyl), its optical isomers, salts and salts of isomers;

     (12)  N-[1-(2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide (thiofentanyl), its optical isomers, salts and salts of isomers; or

     (13)  N-[1-(2-phenylethyl)-4-piperidyl]-N-(4-flurophenyl)-propanamide (para-flurofentanyl), its optical isomers, salts and salts of isomers.

(e)  Depressants.  Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a depressant effect on the central nervous system, including its salts, isomers, and salts of isomers whenever the existence of the salts, isomers, and salts of isomers is possible within the specified chemical designation:

     (1)  Gamma-hydroxybutyric acid (some other names include GHB; gamma-hydroxybutyrate; 4-hydroxybutyrate; 4-hydroxybutanoic acid; sodium oxybate; sodium oxy-butyrate);

     (2)  Mecloqualone; or

     (3)  Methaqualone.

(f)  Stimulants.  Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers:

     (1)  Fenethylline;

     (2)  N-Benzylpiperazine (BZP, 1-benzylpiperazine);

     (3)  N-ethylamphetamine;

     (4)  Catha edulis (Khat or Chat) when cathinone is present;

     (5)  Methcathinone; or

(g)  Any material, compound, mixture or preparation that contains any quantity of the following substances:

     (1)  3-Methylfentanyl (N-[3-methyl-1-(2-phenylethyl)-4-piperidyl]-N-phenylpropanamide), its optical and geometric isomers, salts and salts of isomers;

     (2)  3, 4-methylenedioxymethamphetamine (MDMA), its optical positional and geometric isomers, salts and salts of isomers;

     (3)  1-methyl-4-phenyl-4-propionoxypiperidine (MPPP), its optical isomers, salts and salts of isomers;

     (4)  1-(2-phenylethyl)-4-phenyl-4-acetyloxypiperidine (PEPAP), its optical isomers, salts and salts of isomers;

     (5)  N-[1-(1-methyl-2-phenyl) ethyl-4-piperidyl]-N-phenylacetamide (acetyl-alpha-methylfentanyl), its optical isomers, salts and salts of isomers;

     (6)  N-[1-(1-methyl)-2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide (alpha-methylthiofentanyl), its optical isomers, salts and salts of isomers;

     (7)  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide (benzylfentanyl), its optical isomers, salts and salts of isomers;

     (8)  N-[1-(2-hydroxy-2-phenyl) ethyl-4-piperidyl]-N-phenylpropanamide (beta-hydroxyfentanyl), its optical isomers, salts and salts of isomers;

     (9)  N-[3-methyl-1-(2-hydroxy-2-phenyl) ethyl-4-piperidyl]-N-phenylpropanamide (beta-hydroxy-3-methylfentanyl), its optical geometric isomers, salts and salts of isomers;

     (10)  N-[3-methyl-1-(2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide;

     (11)  N-[1-(2-thienyl)methyl-4-piperidyl]-N-phenylpropanamide (thenylfentanyl), its optical isomers, salts and salts of isomers;

     (12)  N-[1-(2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide (thiofentanyl), its optical isomers, salts and salts of isomers; or

     (18)  Peyote (Meaning all parts of the plant presently classified botanically as Lophophora williamsii Lemaire , whether growing or not, the seeds thereof, any extract from any part of such plant, and every compound, manufacture, salts, derivative, mixture, or preparation of such plant, its seeds or extracts. (e)  Depressants.  Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a depressant effect on the central nervous system, including its salts, isomers, and salts of isomers whenever the existence of the salts, isomers, and salts of isomers is possible within the specified chemical designation:

     (1)  Gamma-hydroxybutyric acid (some other names include GHB; gamma-hydroxybutyrate; 4-hydroxybutyrate; 4-hydroxybutanoic acid; sodium oxybate; sodium oxy-butyrate);

     (2)  Mecloqualone; or

     (3)  Methaqualone.

(f)  Stimulants.  Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers:

     (1)  Fenethylline;

     (2)  N-Benzylpiperazine (BZP, 1-benzylpiperazine);

     (3)  N-ethylamphetamine;

     (4)  Catha edulis (Khat or Chat) when cathinone is present;

     (5)  Methcathinone; or

     (6)  (+/-)cis-4-methylaminorex ((+/-)cis-4,5-dihydro-4-methyl-5-phenyl-2-oxazolamine).

(g)  Any material, compound, mixture or preparation that contains any quantity of the following substances:

     (1)  3-Methylfentanyl (N-[3-methyl-1-(2-phenylethyl)-4-piperidyl]-N-phenylpropanamide), its optical and geometric isomers, salts and salts of isomers;

     (2)  3, 4-methylenedioxymethamphetamine (MDMA), its optical positional and geometric isomers, salts and salts of isomers;

     (3)  1-methyl-4-phenyl-4-propionoxypiperidine (MPPP), its optical isomers, salts and salts of isomers;

     (4)  1-(2-phenylethyl)-4-phenyl-4-acetyloxypiperidine (PEPAP), its optical isomers, salts and salts of isomers;

     (5)  N-[1-(1-methyl-2-phenyl) ethyl-4-piperidyl]-N-phenylacetamide (acetyl-alpha-methylfentanyl), its optical isomers, salts and salts of isomers;

     (6)  N-[1-(1-methyl)-2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide (alpha-methylthiofentanyl), its optical isomers, salts and salts of isomers;

     (7)  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide (benzylfentanyl), its optical isomers, salts and salts of isomers;

     (8)  N-[1-(2-hydroxy-2-phenyl) ethyl-4-piperidyl]-N-phenylpropanamide (beta-hydroxyfentanyl), its optical isomers, salts and salts of isomers;

     (9)  N-[3-methyl-1-(2-hydroxy-2-phenyl) ethyl-4-piperidyl]-N-phenylpropanamide (beta-hydroxy-3-methylfentanyl), its optical geometric isomers, salts and salts of isomers;

     (10)  N-[3-methyl-1-(2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide;

     (11)  N-[1-(2-thienyl)methyl-4-piperidyl]-N-phenylpropanamide (thenylfentanyl), its optical isomers, salts and salts of isomers;

     (12)  N-[1-(2-(2-thienyl) ethyl-4-piperidyl]-N-phenylpropanamide (thiofentanyl), its optical isomers, salts and salts of isomers; or

     (13)  N-[1-(2-phenylethyl)-4-piperidyl]-N-(4-flurophenyl)-propanamide (para-flurofentanyl), its optical isomers, salts and salts of isomers.
