50-3-2016. Violations Complaints Investigations Right of entry.

(a)  Complaints received in writing from employees or their designated representatives relating to alleged violations of this part by manufacturing employers, non-manufacturing employers or distributors shall be investigated in a timely manner by the commissioner.

(b)  Officers or duly designated representatives of the commissioner, upon presentation of appropriate credentials and written notice or warrant to the non-manufacturing employers, shall have the right of entry into any workplace or work area of the employers at reasonable times to inspect and investigate complaints within reasonable limits and in a reasonable manner.

(c)  The commissioner has the same powers, duties and authority to administer and enforce the provisions of this part that are contained in this chapter for the administration and enforcement of occupational safety and health programs; provided, that if there is a conflict between this part and this chapter, this part shall prevail.
