50-3-919. Occupational safety and health administration labor advisory council.

(a)  There shall be created, within the department of labor and workforce development, the Tennessee occupational safety and health administration (OSHA) labor advisory council, referred to as “council,” for the purpose of advising the department on all matters in Tennessee pertaining to OSHA.

(b)  (1)  The council shall be composed of six (6) members appointed by the governor to serve a term of four (4) years.

     (2)  The membership shall be composed of persons who have had at least five (5) years of practical experience on a health safety committee in Tennessee industry or persons who have professional education in the areas of health and safety. The governor shall select three (3) of the members from a list provided by the Tennessee AFL-CIO and three (3) of the members from a list provided by the Tennessee Association of Business.

     (3)  All members shall be appointed for a term of four (4) years or until their successors are appointed and qualified. The term of office for all members shall begin on July 1, following their appointment, except those appointed to fill vacancies.

     (4)  Any vacancy occurring on the council shall be filled by the governor for the unexpired term.

     (5)  The governor may remove any member of the council for misconduct, incompetency or willful neglect of duty.

     (6)  The governor shall annually select a chair from the members.

(c)  Each council member shall be reimbursed for expenses incurred in performing duties required by this section. All reimbursement for travel expenses shall be in accordance with the comprehensive travel regulations promulgated by the department of finance and administration and approved by the attorney general and reporter.

(d)  In addition to any other meetings the labor advisory council may have for the purposes included in subsection (a), the labor advisory council shall meet at least twice a year with the administrator. At the meetings the administrator shall advise the council on the status of all operations of the division and the programs administered within the division. Members of the advisory council shall not be reimbursed for necessary expenses in attending the meetings.
