55-12-130. Approval of reregistration after revocation Transfer of registration to avoid law prohibited Violations Penalties.

(a)  It is unlawful for the commissioner of revenue to reregister any vehicle, the registration of which has been revoked under the authority of this chapter, unless the written approval of the commissioner of safety is obtained prior to the reregistration, and it is unlawful for any owner whose registration privileges have been revoked to sell the vehicle or vehicles for which the registration has been revoked under the authority of this chapter without first informing the purchaser that the registration of the vehicle has been revoked, and that before it can again be registered, the written consent of the commissioner of safety must be obtained.

(b)  The commissioner is authorized to refuse to permit a vehicle to be reregistered as referred to in subsection (a) if the commissioner determines the vehicle was sold with the intention to defeat the purpose of this chapter.

(c)  A violation of subsection (a) or any part thereof is a Class C misdemeanor. It is also a Class C misdemeanor to fail or refuse to surrender upon demand any revoked license to the department of safety or any revoked registration to the department of revenue.
