57-7-112. Sales for sacramental purposes Oath of minister, elder or priest.

(a)  It is lawful for retail druggists to store and sell to ordained ministers or to elders of a church having authority from the church, wine for sacramental purposes; provided, that such minister or elder shall make and subscribe to an oath in writing that the person is a minister, elder, or priest, and that the person needs the wine for sacramental purposes, giving the correct address, and that the wine will not be used for any purpose other than sacramental purposes.

(b)  It is the duty of every druggist selling wine for sacramental purposes to keep the same kind of record of all purchases and sales of wine made as the druggist is required to keep in the case of purchases and sales of alcohol made by the druggist.

(c)  A violation of subsection (b) is a Class C misdemeanor.
