62-3-131. Municipal regulation.

(a)  In addition to the state board of barber examiners, the governing bodies of municipal corporations are authorized and empowered to:

     (1)  Establish, by ordinance, a municipal board of barber examiners consisting of not less than three (3) nor more than five (5) members for the purpose of examining and licensing barbers and supervising and inspecting barber shops, in such a way as to promote the public health and safety and to prevent unlicensed persons or corporations from doing barber work. The municipal corporations shall have the power to charge fees for the same purposes as made by the state; provided, that the fees shall not exceed the amount charged by the state;

     (2)  Provide a penalty for violating the ordinance; and

     (3)  Obtain injunctive relief in the courts to prevent violations of the ordinance.

(b)  The requirements of the ordinance shall be equivalent to or greater than the requirements of this chapter, and no ordinance shall suspend, conflict with or be inconsistent with this chapter.
