65-4-207. Law inapplicable at local option.

(a) The provisions of this part do not apply where any municipality or county by resolution or ordinance declares that a public necessity requires a competing company in that municipality or county.

(b) The provisions of this section shall not apply to telecommunications service providers; provided, that this section shall continue to apply with respect to any ordinance adopted, and any franchise granted pursuant to such an ordinance, prior to June 6, 1995.
