68-115-104. Filling vacancies Appointments.

(a)  A vacancy through expiration of the term of the public member and the members who are licensed physicians shall be filled by appointment by the governor for a term of four (4) years. In the event a vacancy should occur other than by expiration of the term of a public member, the governor shall fill the vacancy for the unexpired portion of the original term.

(b)  Vacancies through expiration of the terms of the members of the commission appointed by the speakers of the senate and the house of representatives shall be filled by appointment by the appropriate speaker for a term of four (4) years. If a vacancy occurs other than by expiration of the term, the appropriate speaker shall fill the vacancy for the unexpired portion of the original term.
