53-4-52. (Pre-1998 Probate Code) Portions given in trust to children or grandchildren as advancements


A portion of an estate given in trust for the benefit of a child shall be an advancement to such beneficiary as if directly given. A portion of an estate given to the children of a deceased child shall be an advancement to that distributive share of the estate, and the grandchildren shall adjust and equalize inequalities among themselves in dividing the surplus coming to them.
