53-7-11. (Pre-1998 Probate Code) Continuance of business of decedent; petition; giving of notice; waiver of notice


(a) An administrator or executor may exercise his discretion in continuing the business of the decedent until the expiration of the current year.

(b) The administrator or executor shall be allowed to carry on the business of the decedent from year to year upon his petition to the judge of the probate court and an order issued thereon by the judge. The petition must be filed each year in order for the administrator or executor to continue the business. The administrator or executor shall give ten days' notice in writing to the heirs of the decedent that he plans to file the petition with the judge; provided, however, that the heirs may waive the notice by acknowledgment of service.

(c) Up to the time of sale or distribution, the administrator or executor shall manage and dispose of the property of the estate for the best interest of the estate.
