53-7-49. (Pre-1998 Probate Code) Defenses by executor or administrator when cause of action arose in lifetime of decedent


When the cause of action originated in the lifetime of the testator or intestate, an executor or administrator may make any defense or pleading which the testator or intestate could have made if he were alive.
